In February 2022, the Constitutional Chamber of El Salvador's Supreme Court issued a landmark ruling promoting the rights of the country's embattled transgender community. It ruled that the constitutional clause prohibiting sex discrimination includes discrimination based on gender identity and that El Salvador's law governing legal name change must allow trans people to change their legal name to reflect their gender identity . The court gave the Legislative Assembly a year to make the necessary reforms.
This jurisprudence, grounded in international human rights law, was a welcome breakthrough for transgender people in a country where transgender activists have for years denounced the high levels of discrimination faced by their communities and pushed for legal gender recognition. To give full effect to the court decision and to address the enduring harm trans people face, the Legislative Assembly should not only enact the constitutional guarantee into law, but also recognize the right of trans people to change their gender designation, a crucial step that has not yet been addressed by the Constitutional Chamber.
