Mobile phone masts should be able to be built without a permit

In our over-regulated Germany, you normally need an official building permit for every kennel and every carport that you want to build on your property.

This should probably no longer apply to mobile operators. that's what politics and the mobile phone industry have decided...

250 new mobile phone masts for the Free State of Bavaria

im Bavaria part of the Munich Merkur (Page 11):

Munich – The state government, local authorities and network operators want to speed up the expansion of broadband and mobile communications in Bavaria once again. To this end, all those involved signed a new “Digital Infrastructure Pact” on Wednesday in Munich. The aim is to expand gigabit networks as comprehensively as possible by 2025.

Bavaria fulfills practically all the network operator's wishes here. The Telefónica boss also demands that the country speak out against frequency auctions.

“Mobile network operators in Bavaria should in future have masts within municipalities of up to one A height of 15 meters can be erected without a permit. That was Bavaria's Minister of Construction Christian Bernreiter (CSU) on October 19, 2022 at the signing of the Pact Digital known infrastructure. A height of 20 meters is even permitted outdoors. The Municipalities should only be “involved” in this.”

"In addition, mobile masts should be able to remain in one place for up to 24 months - without requiring a building permit," explained Bernreiter."

However, the federal government prematurely stopped its gigabit funding for fast Internet this year due to a lack of money. Prime Minister Markus Söder and Finance Minister Albert Füracker (both CSU) protested against this. In Bavaria, approval procedures are now to be accelerated and digitized and existing hurdles lowered.

Among other things, masts should be able to be erected up to a height of 15 meters within communities without a permit process, and up to a height of 20 meters outdoors - but the communities should be "involved". There should also be no space outside. In the future, mobile radio masts should be allowed to be erected for 24 months instead of the previous three. The erection of cell phone systems along state roads and county roads is to be made easier and the use of state and municipal properties is to be simplified.

In the mobile communications sector, the new pact provides for a total of 8400 5G expansion and expansion measures, including more than 2000 new locations and an additional 250 mobile masts. The network operators should also cooperate more closely than before, i.e. use masts together. In the broadband sector, a further 2025 million households are to be supplied with fiber optic connections by 3,1.

Like the CSU before it, the SPD parliamentary group is now also demanding a fictional approval for mobile radio systems. Well over 90 percent of the projects are decided positively anyway. New masts should be easy to build without asking...
