RWE wants to expropriate the farmer Eckardt Heukamp for the climate killer lignite and demolish the village of Lützerath for the Garzweiler opencast mine. But he defends himself legally against it.
At the heart of the legal dispute is the question: Does lignite still serve the common good at all? Because only then can one expropriate.
Lawyer Dr. Roda Verheyen considers an expropriation for lignite and the demolition of Lützerath in view of the stricter climate protection goals and the climate decision of the Federal Constitutional Court as not permissible. Climate protection serves the common good, not the burning of climate-damaging lignite. Roda Verheyen explains in an interview what exactly the legal dispute is about and what the current status is.
